Dixie Chicks' Defamation Case Moved to Federal Court

A defamation suit against the Dixie Chicks has been moved to federal court.

Terry Hobbs, the stepfather of one of three 8-year-old Arkansas boys killed 15 years ago, filed suit against the band in an Arkansas circuit court last year. His claims stem from statements made by lead singer Natalie Maines at a 2007 rally for the three men convicted of the killings. Hobbs claims Maines, who supports a reopening of the case, unjustly accused him of involvement in the murders. He also cited a letter posted on the Chicks' website about "new information" in the murders, including DNA tests showing that one of Hobbs' hairs was found on one of the victims.

Those claims will now be heard before a higher court. Attorneys filed notice last week of the move to federal court, contending that federal jurisdiction applies because the parties are from different states and because the amount of damages being sought is likely to exceed $75,000.

Lawyers for the Dixie Chicks said the singers' statements were made in good faith, without malice, against a man who has become a public figure because of the notoriety of the criminal case. Under the law, a public figure has a higher burden of proof and must show that defamatory statements were made with "actual malice," either known to be false or issued with reckless disregard for the truth. Maines' lawyers also argue her statements were an exercise of free speech under the First Amendment.

Christopher Byers, Michael Moore, and Hobb's stepson Steve Branch were found dead in a ditch near their West Memphis, Ark. neighborhoods in 1993. Damien Echols, Jason Baldwin and Jessie Misskelley, then teenagers, were convicted of the killings. Echols is on death row; Baldwin and Misskelley are serving prison sentences. To supporters who say the three men were wrongly convicted, the men are known as "The West Memphis Three."

I used to love the Dixie Chicks and their music! I have a hard time loving their music and not appreciating or agreeing with what Natalie Maines Sometimes it seems like she opens her mouth without thinking or caring about what she says and how it affects other people feel. Bush put himself in the limelight when he started a war for no good reason! I come from a proud military family that has shed its blood for all Americans to have the right to say whatever they want to say. On the day she said those comments about Bush' personally; it felt as if she was slighting the U.S. military and their families, who risk their lives on a daily basis....almost like she didn't appeciate what the miltary and their families sacrfice for her freedom. I don't appreciate that since I have a great Uncle whose name I will never know. He was KIA approaching the beaches of Normandy during WWII. Natalie Maines needs to stop and think about what she says and how other people will feel about it. That stepfather has the right to sue her and the Dixie Chicks; by association for whatever they are worth. Look at how the Dixie Chicks fought Sony and received many, many millions of dollars from Sony and their own record label...Open Wide Records. Natalie needs to be more thoughtful of others and how they feel......maybe someday soon I'll be able to buy all of the Dixie Chicks albums without feeling guilty....about it!

Yes it is shameful when someone feels they have the right to say whatever - whenever, not caring about the affect it may have on others. It can be very hurtful and distasteful.

However, I like many other Americans believe in freedom of speech. We have so many of our men and women fighting and giving their lives for us to have that right.

It sure would be benefical to know ahead of time if what we have to say will bring any worth to the cause.

I just thank my God every day for the privileges he has given me as an American.

God bless our service men, women and our great country.

Natalie Maines has a big problem with "hoof in mouth" disease. Although I loathe country music, I absolutely do support her right to freedom of speech and her comments on the absolute criminal who ruined our country George W. Bush were dead on. I applaud her for her truth. As for this current brouhaha, the guy is just a gold digger and he figures he can nail some serious Ka Ching by suing her. I hope he loses his rear end off.

Uh Bush is a moron. Heaven forbid we speak the truth... or Natalie speak the truth. He lied to us about WMDs to start a SECOND war after 9/11. We are entitled to criticize our government by virtue of the constitution. If George W couldn't handle the 'criticism' he shouldn't have run for office, but he seems to have moved on. The only people still angry over this is a bunch of red necks who can't accept their government lies to them on a regular basis... across party lines. There is no such thing as an honest politician. I say we ship them all off to a third world country, let them see what their lives could be like and then see if they are so eager to cheat, lie, and steal from us. Lets go back to "We the People" and stop padding the pockets of useless politicians like Bush. Why the right wing supports a former National Guarder who went AWOL and ran every business he ever headed into the ground, I have no idea. Ignorance must be bliss.

Personally, I don't care what she said about Bush and I don't know enough about this case to form an opinion. What I do know is that, whatever repercussions there are, our freedom of speech shouldn't have to stop at our borders. Maybe I think it's tacky, but she had a right to say it. As for lassarina's comment:
"And anyone who wants to blast me for being an uneducated Southerner, you are completely wrong in your assumption. I am simply excorsizing my right of free speech as an American citizen."

Sometimes it's best to be thought a fool than to open your mouth and remove all doubt. I believe you meant you're exercising your right of freedom of speech...otherwise you're trying to rid yourself of it through a Roman Catholic ritual.
