Indiana State Fair Lawsuit Update: Jennifer Nettles' Deposition Refutes Witness Claim

INDIANAPOLIS (AP) - An attorney says Sugarland's version of what happened before last summer's deadly stage collapse at the Indiana State Fair is inconsistent with another witness account.

The Indianapolis Star reports it obtained a partial transcript of singer Jennifer Nettles' deposition in a series of lawsuits over the disaster.

The Star says Nettles testified that the country duo was never told fair officials had asked to delay the concert because of an approaching storm and that the band probably would have postponed the show if they had been asked. State Fair Executive Director Cindy Hoye testified that she asked Sugarland's tour manager to delay the show but was told that the band refused.

Attorney Kenneth J. Allen says Nettles' version is "inconsistent." Band spokesman Allan Meyer called Allen's remarks "scurrilous."

My ex-wife and I attended the concert, and sat in the fifth row right side in front of where the stage collasped. we made the decision to leave after I viewed the sky, and heard of the approaching bad storm. We got half way to the stand of permanant bleachers beofre the storm collasped the roof behind up onto the very seats we were sitting in. I don't believe state fair officials gave proper notice of the intensity of the approaching bad storm, and if it hadn't been for the weather updates on hand held cell phones, I wouldn't have made my decision to leave when I did. We continue to pray for all involved. It is not fair to blame Sugarland, as all they wanted to do is play their music and if they were given the same luke warm warning about the approaching bad weather the fans were given, they too would have had no idea how bad it really was. The real blame as I see it falls on the failure to evacuate the crowd given the approaching bad weather. The stage construction was also obviously inadequate, but no one would have been hurt if the fair would have evacuated the crowd based on the weather updates.

Jennifer is one of the best singers out there. She definitely didn't ruin Hello or any other song. She made them all better. I hope Sugarland's new tour is going well and they can put all of this behind them. It is very sad that it happened but it was a natural disaster. No one was going to know that a massive wind would take down the stage.
